Terms of Service
Agreement
These terms govern your use of the ishvana.com website (the "Site")
and the Ishvana desktop application (the "Software"), both operated by
Swordsfall Studios LLC ("we," "us," "our"). By using the Site or installing the
Software, you agree to these terms. If you don't agree, don't use them.
License grant
Ishvana is licensed, not sold. When you purchase a license, you receive a non-exclusive, non-transferable right to install and use the Software on up to three (3) machines you own or control, for personal or commercial creative work, indefinitely.
If you buy a new computer, you can deactivate an old machine from your account and activate the new one. The three-machine limit is enforced by our license server; see the Privacy Policy for details on what's recorded during activation.
Your work is yours
We claim zero ownership over anything you create with Ishvana. Your manuscripts, lore, characters, maps, prompts, and every other creative artifact belong to you, full stop. We do not read, store, train on, or access your writing. The Software runs on your machine and your data stays on your machine in standard file formats (SQLite, .docx, Markdown) that you can open with any compatible tool, even if we disappear tomorrow.
Permitted use
You may use Ishvana to:
- Write, edit, and publish fiction, non-fiction, or any other text you create
- Build, organize, and export worldbuilding databases, character knowledge graphs, and all related creative materials
- Sell, give away, license, or otherwise distribute the writing you produce — including commercially, without royalties to us
- Install the Software on up to three machines you own, concurrently
Restrictions
You may not:
- Resell, sublicense, or redistribute the Software itself or any part of it
- Reverse-engineer, decompile, or otherwise attempt to defeat the license-checking system
- Share your license key with people outside your immediate household
- Use the Software to create, store, or distribute content that is illegal in your jurisdiction (child sexual abuse material, content that promotes real-world violence against identifiable individuals, or content that violates other laws)
- Use the Software to impersonate a real person in a way designed to deceive or defraud
Writing dark, violent, erotic, or otherwise controversial fiction is fine — Ishvana is a tool for authors, and authors write hard things. The restrictions above target illegal content and fraudulent impersonation, not creative work that some people might find uncomfortable.
Free trial
We offer a 14-day free trial of Ishvana. Trial licenses are limited to one per email address. During the trial, you have access to all features of the Software except where explicitly noted. At the end of 14 days the trial license expires and you'll need to purchase a full license to continue using the Software.
If you abuse the trial — for example, signing up for multiple trials with disposable email addresses or using the trial to complete a full commercial project with no intent to purchase — we may terminate your trial early. Good faith is assumed.
Refunds
We offer a 14-day, no-questions-asked refund on any paid license. See the full Refund Policy for details on how to request one and what happens to your license after a refund is processed.
Warranty disclaimer
THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
That said, we do our best to ship software that works. We test, we listen, we fix bugs quickly. If something breaks for you, please report it to support@ishvana.com and we'll look at it.
Limitation of liability
IN NO EVENT SHALL SWORDSFALL STUDIOS LLC BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE, EXCEEDING THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Translation: if something goes catastrophically wrong, the most you can recover from us is the price you paid for the Software. Back up your work. Ishvana writes to standard file formats that you should regularly back up through your normal system backup routine.
Termination
You may stop using the Software at any time by uninstalling it. We may terminate your license if you materially violate these terms — for example, redistributing the Software, defeating the license-checking system, or using the Software for illegal activity. If we terminate your license in good faith for a non-violation reason (e.g., we discontinue the product), we will refund a prorated portion of any unused subscription fees (not applicable since Ishvana is a one-time purchase) or other payments.
Changes to the Software
We update Ishvana regularly with new features and fixes. Updates within the current major version (1.x) are included in your purchase. Major version upgrades (2.0 and beyond) may require a paid upgrade, at a discount for existing license holders. We will never force you to upgrade — your current version keeps working indefinitely, even after a new major version ships.
Changes to these terms
We may update these terms occasionally. If we make material changes, we'll announce them on the Site and email active license holders. Non-material changes (typo fixes, formatting, clarification) may happen without notification. Your continued use of the Software after a change constitutes acceptance.
Governing law
These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of laws principles. Any dispute arising out of or related to these terms will be resolved in the state or federal courts located in Oregon, unless applicable consumer protection law in your jurisdiction grants you additional rights that cannot be waived.
